‘I/We Go Our Way! MCC Civic Group against MCC Commissioner’s Proceedings

Mangaluru: Seems like “I/We Go Our Way-and You All Go Your Way?” kind of attitude from Mangaluru City Commissioner Mohammed Nazeer, and Officials of MCC when it comes to the handling of certain civic issues without noticing the public, before they carry on with the work illegally. Here is one such incident when a case is pending with Lokayukta in Bengaluru, MCC Commissioner and other six officials associated with MCC have gone forward and done a concrete work on Bejai New Road-7th Cross -Mangaluru. When the matter is sub- judice before a legal authority, conducting meeting and drawing proceedings is against law, and for this said wrong doings MCC civic group has filed a case with Karnataka Lokayukta against the commissioner and 6 others who were part of this proceedings. Apart from that, a small protest was held today, 27 November in front of MCC Administrative building by MCC Civic Group, joined by Aam Aadmi party members.

Regarding the said above Road (Bejai New Road 7th Cross) residents of that vicinity had protested many times against the pathetic condition of their road demanding concretization. In 2015 a case was filed in Office of the Lokayukta Bangalore regarding substandard road asphalting work by local members of MCC Civic Group. The said asphalt work done was washed out by rains in barely 1 month. Therefore the said matter was escalated to MCC and subsequently to the Lokayukta for redressal. In the meantime, a status quo ordered by the Lokayukta.

As per MCC Civic Group lead and RTI activist Ajoy D’Silva a Case No COMPT/UPLOK/MYS/8602/2015 was filed in 2015 regarding substandard asphalting work which is still pending in Office of the Lokayukta Bangalore who in turn had issued a status quo. “But recently a residents of that area backed by area corporator Lancelot Pinto had staged a protest, and just in time of forthcoming election to please the residents, the road work was taken up and completed in no time-I am okay with the good work done in restoring the road but why was the work started when there was a status quo from Lokayukta, and also civic group was also not informed about the Nadavali meeting. I am asking why people never gathered similarly at the time when the said substandard asphalt work was done some time ago,” said D’Silva.

The leader of MCC Civic Group and Activist Gerard Towers addressing the media during the protest said, “It’s wrong on part of MCC Commissioner to give orders and complete the 7th Cross Bejai New Road when a case is pending and also a status quo by Lokayukta. The Commissioner is misusing public money without calling for a meeting or even informing the citizens. MCC is full of corruption, and surely this project is hand-in-glove with the ward corporator, and for vote bank since the election is soon approaching. We need an answer from the Commissioner, if not we will intensify our agitation, and will even go once again to Bengaluru and file a petition against MCC Commissioner and six associated in this regard”.

Bejai New Road- 7th Cross Road

Rajesh Shetty, yet another MCC Civic Group member who had drafted a complaint letter to the Registrar of Karnataka Lokayukta-Bengaluru speaking to Team Mangalorean said, ” Dated 10.9 .2017 MCC commissioner Mohammed Nazeer conducted a nadavali/ proceedings regarding road concrete work in ward no 31 Bejai new road 7th cross. On 6/10/2017 I informed the MCC commissioner regarding fake proceedings and why complainant was not been Invited for the proceedings…..The complainant who was denied of his right to attend the proceedings in violation of the principle of natural justice. When the matter is sub- judice before a legal authority, conducting meeting and drawing proceedings is against law. The drawing of proceedings without informing the complainant and also to the Lokayukta Bengaluru raises doubts as to the legal sanctity of the proceedings. That is the reason we decided to have a peaceful protest outside MCC organized by MCC civic group and Aam Aadmi party members. This protest was regarding fake proceedings conducted by MCC commissioner without informing the complainant”.

The petitioner Rajesh Shetty (Complainant) has filed a complaint with Karnataka Lokayukta -Web based Registration (Under Section 7 of the Karnataka Lokayuktha Act, 1984) -Complaint Number: LOK/MYS/9387/2017, pertaining to proceedings drawn by the Respondents (Namely- MCC Commissioner-Mohammed Nazeer; MCC Executive Engineer- Lingegowda; MCC Asst, Executive Engineer-Devaraj; MCC Junior Engineer- Laxman; Principle KPT, Bantwal-Chennagirigowda; MCC Consultant (Technical Advisor)-Dharmaraj; and MCC Area Ward No 31 Corporator-Lancelot Pinto) regarding road repair work without informing the complainant in this matter.

District Convenor of Aam Aadmi Party Rajendra Kumar also joined in the protest today.
