Girija Balegar to get justice soon, court orders arrest of accused

Udupi: Girija Baligar who was cheated of Rs 2,00,000/- by a stranger, will now be getting justice soon. The matter was released by the Human Rights Protection Foundation Udupi two weeks ago and widely published in the media. Now the JMFC Mangalore has ordered the arrest of the accused Ram Poojary and the seizure of his properties.

Accordingly, the misappropriated amount of Rs 2,25,000/- shall be repaid to the victim by selling Ram Poojary’s properties.

Background of the story

80 year old spinster Girijamma earned her living by selling bangles. Since she did not have a shop, she had to go door to door to sell the bangles. She had earned Rupees Two lakhs by selling bangles at fares and markets and deposited the same at Kadri Cooperative Bank as a fixed deposit with the hopes that it would come to her aid during her old age.

Ram Poojary, a stranger befriended Girijamma saying, “You are just like my mother, I’ll take care of you during your last days”, he assured her with sugar-coated words and misappropriated Girijamma’s lifetime savings. With empty promises of repaying the amount, he later absconded.

Girijamma approached an advocate in 2014 and moved the Civil Court of Mangalore which passed its judgement in 2016 in that Ram Poojary had to repay Girijakka an amount of Rs 2,20,000/- which included interest. After 10 months of struggle to get back her money, Girijamma approached the Human Rights Protection Foundation, Udupi.

Since Girijamma is suffering from health issues like diabetes and blood pressure, she is unable to sign and submit her complaint, we sent a complaint to the Tribunal from our Foundation.

Six months have passed since the Assistant Commissioner of Mangalore ordered the Konaje Police Station to implement the order passed in favour of Girijamma. Seeing no hopes in the implementation of the order, Girijamma who is on her deathbed prays that, “Even if I don’t get the money, it should not go to Ram. Please give it to an orphanage.”

Advocate Prasad Bhandary who had handled the case earlier filed an application against Ram Poojary for contempt of Court and requested that Girija Balegar’s money is repaid to her by seizing Ram Poojary’s movable property.

Konaje Police acting upon the orders of the Court arrested Ram Poojary and seized his maxicab and produced him before the Court.

The Court is making arrangements for the Maxicab to be sold in order to pay Girija her money.
