Independent Team for Police Complaint Authority should be Formed – Justice Pachapure
Mangaluru: “There was a demand to form an Independent Investigating team to investigate the complaints received by the Police Complaint Authority. In this regard, the government so far has not taken any decision”, said the Former Judge of Karnataka High Court Justice A S Pachapure in a programme organized by the Mangaluru Bar Association in association with State Police Complaint Authority, District Administration and District Legal Services Authority at the district Court premises, here on April 19.
Addressing the gathering Justice A S Pachapure said, “We have also submitted a memorandum for the presence of officers in the investigating team. The authority has the right to investigate the complaints on Police Atrocities but does not have the right to give the judgement. The investigation report should be handed over to the government and the decision will be taken by the government considering the report. But in the case of minor incidents, the Authority should be given the right to give judgements and retired Judges should be appointed”, said Puchapure.
According to the Karnataka Police (Amendment) Act, 2012 the Police complaint authority has been formed. According to the Amendment of 20(C) to 20(G) amendments, if a prisoner dies in jail, atrocities in the police station, injuries during custody and illegal arrest, one can file a complaint with the authority. If the complaints are serious one can file a complaint with the State Police Complaint Authority, if the complaints are not serious they can file it with the district Police Complaint Authority. If there are complaints the authority has the right to investigate. So far we did not get any serious complaints”, said Pachapure.
The president of the District Legal Services Authority and District Session Judge K S Bilagi also spoke on the occasion.
