MVRV to organize ‘Awareness Meeting on Moolageni Act and Rules’
Moolageni Vokkalu Rakshana Vedike (MVRV) to organize an ‘Awareness Meeting on Moolageni Act and Rules’ on 8 January 2017 at Don Bosco Hall- Mangaluru at 10 am.
Mangaluru: On 30 November 2016, Mulgars’ Association president Clarence Pais, aged 88 and the senior most advocate in Mangaluru had held a press meet to inform the media persons about the Association and some individual Mulgars having filed writ petitions before the Karnataka High Court against the Mulageni Act and also an interlocutory application for a stay against the Act as well as the rules of the Act.
Advocate Pais had appeal to the district administration not to precipitate the matter by implementing the Act and rules which are challenged before the High Court, and also requested members of the public to not sign agreements related to Mulageni properties as the Mulgars writ petition before High Court was with a view to declaring the Act and rules unconstitutional. He had also informed the Banks and financial institutions that any mortgage loan that is given on Mulageni properties will be at their own risk in view of pending writ petition before the court.
Tit for tat, in response to the press meet held by Mulgars’ Association, the members of ‘Moolgeni Vokkalu Rakshana Vedike (R) (MVRV) also held a press meet today, 6 January 2017 to express their views and demands on this issue. Addressing the media persons during the press meet held at Mangalore Press Club, Maxim D’Silva-President of MVRV said, ” Moolageni is a perpetual lease, as defined under the T.P.Act. The tenant is entitled to enjoy the property permanently and his right to the property is inheritable. In the Coastal Districts, this system has prevailed ever since 1856 or so. The Moolageni tenants of the Coastal Districts wanted that the right of the landlord is vested in them and that they could enjoy the ownership right to the property.”
Also speaking during the press meet, Gowri Shanker-legal adviser for the Vedike said, ” The State Legislature of Karnataka accepted the requests of the Moolageni Tenants and conferment of ownership on Moolageni Tenants Act 2012. Act was unanimously passed and this Act received the President of India assent on 13.07.2012 and it has come into force on 20.12.2012. The Moolidar’s i.e, the Landlords challenged the validity of this Act and filed a writ petition before the State High Court, and the matter is pending. Though the landlords filed a petition before the High court for granting a stay order, the High Court did not pass any order for stay.”
“Therefore, the Act has come into force and the Rules are framed, and the same has come into force on 7.11.2016. The Moolageni Tenants are filing applications before the Competent Authority under the Act for grant of ownership right on them. They are willing to pay the compensation as laid down in the Act, which 1000 times the Annual Moolageni. The process of filing the application and holding an inquiry on such applications must continue as there is no Stay granted by the State High Court.” added Gowri Shanker.
The Vedike have decided to hold an awareness meeting pertaining to this issue on 8.1.2017 at Don Bosco Hall, Mangaluru at 10.00 am, for all Moolgeni members and non-members, and have requested them to come in large numbers, where they can receive information about Moolageni Act and its Rules, which would be useful for them in along run.
